Terms of Service

By accessing or using STRUQO LLC("the Service," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time. Continued use after changes constitutes acceptance.

STRUQO LLC is a software platform that provides:

• BRRRR deal analysis and scoring using algorithmic models
• Rehab cost estimation using regional cost multipliers and user inputs
• Automated valuation model (AVM) data sourced from third-party providers including RentCast
• Rental market data, comparable sales, and rent estimates from third-party APIs
• Community-submitted rehab project data for informational benchmarking

All outputs are estimates and projections only. They are not appraisals, broker price opinions, certified valuations, or professional advice of any kind.

STRUQO LLC is not a licensed appraisal company and does not employ licensed appraisers. The ARV estimates, AVM values, and rehab cost estimates provided by this platform do not constitute appraisals as defined under the Uniform Standards of Professional Appraisal Practice (USPAP) or any applicable state law.

You may not use outputs from STRUQO LLC as:

• Evidence of value in a mortgage application or loan underwriting process
• A licensed appraisal for any regulatory, legal, or financial purpose
• A substitute for an independent property inspection or contractor estimate
• Professional investment, financial, tax, or legal advice

You acknowledge that real estate investing involves substantial risk, including the potential loss of your entire investment. STRUQO LLC makes no representation that any deal will perform as projected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRUQO LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR CLAIM ARISING FROM YOUR RELIANCE ON ANY ESTIMATE, SCORE, PROJECTION, OR OTHER OUTPUT FROM THE SERVICE.

This includes but is not limited to: purchase price overpayment, rehab cost overruns, refinance shortfalls, rental income shortfalls, loss of earnest money, or any other investment-related loss.

Outputs depend on the accuracy of (a) your inputs, (b) third-party data providers including RentCast, and (c) our algorithmic models. We do not guarantee the accuracy, completeness, or timeliness of any data. Third-party APIs may be delayed, unavailable, or inaccurate. You are solely responsible for independently verifying all data before acting on it.

If you submit rehab project data, photos, or other content to the platform, you grantSTRUQO LLC a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating and improving the Service, including training and improving our analytical models.

You represent that you own or have the right to submit any content you provide, and that submitted content does not violate any third-party rights or applicable law. You may only submit photos and data for properties you own or have explicit written authorization to photograph and share.

Paid subscriptions are billed monthly or annually via Stripe. You may cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not issue refunds for partial periods except where required by applicable law.

We reserve the right to change pricing with 30 days' notice to your registered email address.

You agree not to:

• Use the Service to provide unlicensed appraisal services to third parties
• Scrape, copy, or redistribute any data from the Service
• Use the Service for any unlawful purpose
• Attempt to reverse-engineer or circumvent usage limits
• Submit false, misleading, or fabricated project data
• Use outputs in any mortgage, lending, or underwriting application

You agree to indemnify and hold harmless STRUQO LLC and its officers, directors, employees, and agents from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your investment decisions, or (d) your submission of any content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR ESTIMATE IS ACCURATE.

IN NO EVENT SHALL STRUQO LLC BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS OR (B) $100.

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the AAA Commercial Arbitration Rules in Indiana, except that either party may seek injunctive relief in a court of competent jurisdiction in Indiana.
